Transactional Emails without using Opt-In subscription management

We do not want to use Opt-In Sub Management however would like to make use of transactional emails. For example if a user requests a download and the auto response would be to send them a download link. We may not be able to send them that email if they are globally unsubscribed.

Do you have any suggestions for the scenario without using Opt-In Sub Management?
